Terms of Service

These terms are an agreement between you and Perforance for using perforance.net, Perforance One, the Perforance API and the Perforance Discord bot (together, "the Service"). By using the Service, you agree to them.

Who can use it

You must be at least 13, or the minimum age where you live if that's higher, and allowed to agree to these terms. If you use the Service for a group or organisation, you confirm you're allowed to act for it.

Your account

You sign in with your Roblox account. Keep it secure. You're responsible for what happens in your Perforance One workspace, including who you give permissions to. Tell us right away at legal@perforance.net if you think someone has used your account without permission.

Plans and billing

• Perforance One costs $5 USD a month or $20 USD a year for each group, plus any taxes. Payments are handled by our payment processor.
• Subscriptions renew automatically until you cancel. You can cancel at any time. That stops future renewals, and you keep access until the end of the period you've paid for.
• All payments are final and non-refundable, including for partly used periods, unless the law where you live requires a refund.
• Your subscription starts as soon as you pay. If you're in the EU, EEA or UK, you ask us at checkout to start straight away. By doing that, you acknowledge you lose your 14-day right to cancel once the service has started.
• If a payment fails, we may pause your workspace until it's paid. If we raise prices, we'll tell you at least 30 days before your next renewal, and you can cancel before then.

Acceptable use

Don't use the Service to:

• break the law or the Roblox or Discord terms;
• harass, exploit or harm anyone, especially minors;
• upload malware;
• try to get into accounts or data that aren't yours;
• overload the Service, or scrape it, resell it or reverse-engineer it.

We may suspend or close accounts that do any of these.

Your content

You own what you put into Perforance One. You give us permission to store and process it only to run the Service for you. You're responsible for having the right to add it, including information about your group's staff.

Our service

We own Perforance, its software and its branding. Perforance isn't affiliated with, endorsed by or sponsored by Roblox Corporation or Discord Inc. We work to keep the Service available and secure, but we may change features, and we can't promise it will never be interrupted or have errors.

Disclaimers and liability

To the extent the law allows, the Service is provided "as is", without warranties of any kind. Perforance isn't liable for indirect or consequential losses, or for lost profits or data. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that can't be limited by law, or takes away rights you have as a consumer.

Ending things

You can stop using the Service and ask us to delete your data at any time. We may suspend or end your access if you seriously or repeatedly break these terms. When that happens, we'll tell you where we reasonably can.

Changes

We may update these terms. If a change matters, we'll give notice before it takes effect. If you keep using the Service after that, you accept the new terms.
